This document does two jobs in one place. Part A sets the ground rules for how anyone using BeerZap — attendees, organizers, and vendors alike — is expected to behave on the platform. Part B explains how prizes and rewards actually work: what "no purchase necessary" means here, how eligibility and age requirements apply, and who is responsible for actually handing out a prize. It's incorporated by reference into the Organizer Terms of Service (Section 8) and the Vendor/Brewer Participation Terms (Section 9), and referenced from the Privacy Policy (Section 6) for the alcohol-eligibility age line.
1. Scope and Who This Applies To
This document contains acceptable-use rules (Part A, Sections 3–5) and prize-promotion terms (Part B, Sections 6–12) that apply to everyone who uses the BeerZap Service: attendees, organizers, and vendors/brewers.
Organizers and vendors accept this document as part of accepting the Organizer Terms of Service or the Vendor/Brewer Participation Terms, respectively — it is incorporated into those agreements by reference, and a violation of this document is also a violation of that underlying agreement.
Attendees — an important, unresolved open item. BeerZap does not currently have a signup, account, or clickwrap step of any kind for attendees (see Privacy Policy Section 1.2 — attendee sessions are anonymous, with no acceptance record of any kind). There is no mechanism today for an attendee to formally "accept" this document the way an organizer or vendor does. This section states the conduct standard BeerZap expects, and can technically enforce (through revoking station-scan access, removing a rating, or disqualifying a leaderboard entry) for anyone participating in an event — but it does not create, and should not be read as creating, a signed or clicked contractual relationship with attendees that doesn't otherwise exist.
2. Relationship to Other BeerZap Documents
This document works alongside, and does not replace, the Organizer Terms of Service, the Vendor/Brewer Participation Terms, and the Privacy Policy. Where those documents address billing, liability, indemnification, or data practices, this document does not restate them — it focuses specifically on conduct standards and prize/reward mechanics.
PART A — Acceptable Use
3. General Platform Rules
When using the Service, you agree not to:
- Scrape, reverse-engineer, decompile, or attempt to extract the Service's underlying software, station locations, or prize logic, except as expressly permitted by law;
- Resell, sublicense, or transfer your access to the Service (including a vendor login, an organizer account, or a QR-code/station credential) to anyone else without BeerZap's consent;
- Attempt to bypass, spoof, or falsify the GPS/geofence check used to verify a station capture — for example, faking your device's location to record a capture without being physically present;
- Use automated means (bots, scripts, or scripted device farms) to generate captures, ratings, or account activity;
- Create or use multiple attendee sessions, accounts, or devices to manipulate a leaderboard standing, prize eligibility, or completion count;
- Harass, threaten, or abuse another attendee, vendor, organizer, or BeerZap staff member, whether in person at an event or through the Service;
- Impersonate another person, vendor, or organizer, or misrepresent your affiliation with any of them; or
- Use the Service to violate any applicable law, including any law governing alcohol service, promotions, or prizes.
4. User-Generated Content Standards
Ratings, reviews, photos, and any other content you submit through the Service (collectively, "UGC") should reflect your own genuine experience. You agree not to submit UGC that:
- Is fake, incentivized without disclosure, or intended to manipulate a vendor's rating or a prize outcome;
- Is defamatory, harassing, or knowingly false about a specific vendor, organizer, or other attendee;
- Infringes another party's intellectual property or privacy rights;
- Is sexually explicit, unlawful, or promotes violence; or
- Makes a false or misleading health, safety, or allergen claim about a vendor's product (a genuine allergen or product concern should be reported directly to the vendor and organizer, not posted as a review).
5. Content Moderation
BeerZap and/or the event organizer may remove, hide, or refuse to publish any UGC, rating, or leaderboard entry that violates Section 4, at their discretion and without prior notice. If you believe your content was removed in error, you may contact legal@beerzap.com. BeerZap does not currently operate a formal appeal or review process for moderation decisions — disputes are handled case-by-case.
PART B — Prize and Reward Mechanics
6. How Prizes and Rewards Work
Organizers can configure prizes for their event based on completion criteria they choose (for example: capture every station, be among the first N attendees to finish, a random drawing among attendees who meet a threshold, or a manual pick by organizer staff). Where enabled, individual vendors can separately fund and configure their own attendee-redeemable reward, independent of the organizer's prizes, subject to the organizer's approval and — for any alcohol-category reward — the two-layer compliance-acknowledgment process described in the Organizer Terms of Service Section 7 and the Vendor/Brewer Participation Terms Section 5.
BeerZap's role is limited to software: tracking completion criteria and identifying who has met them. BeerZap does not fund, hold, manufacture, ship, or physically hand over any prize or reward. Prizes are claimed in person, from the organizer or vendor, at the event.
7. No Purchase Necessary
No purchase, payment, or consumption of alcohol is required to enter, participate in, or win any prize or reward offered through the Service. A station capture (a free GPS-verified location check-in) does not require buying anything from a vendor or organizer. Where a prize mechanic involves a random drawing among eligible attendees, the odds of winning depend on the number of eligible entrants at that event; the organizer offering the prize is responsible for disclosing odds where required by law.
Sweepstakes-law flag: some states impose specific registration, bonding, or disclosure requirements on prize drawings above certain value thresholds, separate from the "no purchase necessary" principle stated above. Organizers running a raffle-style prize mechanic should confirm their own state's requirements independently.
8. Eligibility and Age
To participate in any prize or reward mechanic, you must meet whatever age or eligibility requirement the organizer sets for entry to the event generally. If a prize or reward involves alcohol, you must additionally meet the legal drinking age in the jurisdiction where the event takes place, and organizer or vendor staff may require you to present the same ID, wristband, or hand-stamp used for the event's own age-verification checkpoint before handing over that prize — this is the same physical eligibility check the event already runs for all alcohol service, not a separate or looser one (see Organizer Terms of Service Section 7 and Vendor/Brewer Participation Terms Section 5). BeerZap itself does not verify your age or identity at any point — that check is performed entirely by the organizer's or vendor's own staff, under the organizer's own alcohol license.
9. Void Where Prohibited
Prizes and rewards offered through the Service are void where prohibited by law. Some jurisdictions restrict or prohibit specific prize mechanics involving alcohol — including "free goods" or tied-house-style promotions — regardless of how carefully age is verified. Confirming that a specific prize or reward mechanic is lawful in the jurisdiction where an event takes place is the organizer's and/or vendor's responsibility, not BeerZap's.
10. Prize Fulfillment Responsibility
The organizer (for organizer-configured prizes) or the vendor (for vendor-funded rewards) is solely responsible for procuring, funding, and physically delivering any prize, and for any tax, regulatory, or consumer-protection obligation that comes with doing so. BeerZap is not a party to that fulfillment and does not guarantee that any prize will actually be delivered, be available in the quantity described, or match its advertised description.
11. No Warranty on Prizes or Rewards
BeerZap makes no representation or warranty about the value, availability, fitness, or safety of any prize or reward offered by an organizer or vendor, and disclaims all liability arising from a prize's fulfillment or non-fulfillment, to the maximum extent permitted by law. Redemption caps a vendor sets are described as "up to N redemptions," not "exactly N" — see Vendor/Brewer Participation Terms Section 5.
12. Alcohol-Promotion / Tied-House Caveat
Where an alcohol-category prize or reward is offered, the organizer and (for vendor-funded rewards) the vendor each represent that they have independently confirmed the mechanic complies with their own state's alcohol-promotion and tied-house law, per Organizer Terms of Service Section 7 and Vendor/Brewer Participation Terms Section 5. The compliance-acknowledgment steps built into the Service are a process safeguard, not a legal determination — BeerZap does not verify or endorse the legality of any specific prize or reward mechanic under any state's alcohol law.
13. Termination and Removal
An attendee may be disqualified from a leaderboard or prize, and may have station-scan access revoked, for violating Sections 3 or 4. A vendor's or organizer's content or reward may be removed under the termination provisions of their respective Terms (Vendor/Brewer Participation Terms Section 12; Organizer Terms of Service Section 13) for a violation of this document.
14. Modification of Terms
BeerZap may update this document from time to time. For any change we determine to be material, we will provide at least 14 days' advance notice by email and/or in-app notice to organizers and vendors before the change takes effect, consistent with the modification clause in their respective Terms.
15. Governing Law
To the extent this document is enforced against an organizer or vendor, it is governed by, and disputes are resolved under, the arbitration, governing-law, and venue provisions of the Organizer Terms of Service Section 14 or the Vendor/Brewer Participation Terms Section 14, respectively — this document does not create a separate, independent dispute-resolution process. No arbitration or governing-law clause currently applies to attendees, consistent with the open question flagged in Section 1 above.
16. General Provisions
Severability. If any provision of this document is found unenforceable, the remaining provisions remain in full effect. Entire agreement. This document, together with the Organizer Terms of Service, Vendor/Brewer Participation Terms, and Privacy Policy, forms the entire agreement between BeerZap and the applicable party regarding acceptable use and prize mechanics. Notices. BeerZap may provide notices via the email associated with an organizer's or vendor's account, in-app notification, or posting to the Service.
